Terms and Conditions

These Terms and Conditions (“Terms”) govern the use of services and the website of Hormood Care Services (“we,” “our,” or “us”). By accessing our website or receiving services, you agree to these Terms.

1. Services

Hormood Care Services provides home care and community-based services in accordance with Minnesota Department of Human Services (DHS) licensing requirements, including applicable 245D standards. Services may include Basic Support Services (PCA, Homemaker, Companion Care), In-Home Support (IHS, Family Support, Respite), and Community-Based Services (ILS).

2. Eligibility & Authorization

Services are provided only to individuals who meet DHS eligibility requirements, have valid service authorization, and provide accurate information. We reserve the right to decline services if eligibility or authorization requirements are not met.

3. Individual Rights & Responsibilities

Individual Rights

  • Be treated with dignity and respect.
  • Receive services in a safe and person-centered manner.
  • Participate in service planning and file complaints without retaliation.

Individual Responsibilities

  • Provide accurate health and contact information.
  • Treat our caregiving staff respectfully.
  • Maintain a safe service environment for our staff.

4. Scheduling & Cancellations

Service schedules are arranged in advance. Changes or cancellations should be reported as soon as possible. Repeated no-shows or unsafe conditions may result in service modification or termination.

5. Payments & Billing

Services may be billed through DHS programs, insurance, waivers, or private pay. Private-pay clients are responsible for agreed-upon fees. Unpaid balances may result in the suspension of services.

6. Care Limitations

We do not provide medical diagnosis or emergency medical treatment. Our services do not replace licensed nursing care unless specifically authorized. In emergencies, individuals should call 911 immediately.

7. Confidentiality & Safety

We comply with HIPAA, Minnesota data privacy laws, and 245D requirements. As mandated reporters under the Minnesota Maltreatment of Vulnerable Adults Act, we are required by law to report suspected abuse or neglect.

8. Complaints & Grievances

Individuals have the right to file complaints without retaliation. Complaints may be submitted to Hormood Care Services management, the applicable County agency, or the Minnesota Department of Human Services.

9. Website Use & Liability

Website content is for informational purposes only. Unauthorized use or misuse of website content is strictly prohibited. Hormood Care Services is not liable for indirect damages related to service use or website access to the extent permitted by law.

10. Termination & Governing Law

Services may be terminated at the individual’s request, if DHS authorization ends, for non-payment, or for unsafe conditions. These Terms are governed by the laws of the State of Minnesota.
